The information and services provided by Infinitely People Products are for the sole purpose of individuals looking for employment, opportunities and career information and for employers seeking to recruit staff.

Infinitely People permits access, use and interaction with our Products subject to these Terms and Conditions of Use. Any party using our Products for any other purpose other than those specifically stated in these Terms and Conditions of Use shall immediately be banned from using our Products

You must read and agree to our Terms and Conditions of Use and our Terms of Business as they form a binding contract between you and Infinitely People Limited.

In this Disclaimer

• "we" "us" "our" means Infinitely People Limited;
• "Product" and "Products" means Infinitely People (including the Infinitely People website, mobile app and in-app browser) and Infinitely People’s product Bounce (including the Bounce website, mobile app and in-app browser) and any other features, apps, technologies, software, products, or services offered by Infinitely People Limited
• "Use of the products" and "Use the products" means accessing, browsing or registering to use our Products in whatever manner;
• "Terms of Use", "Terms and Conditions of Use" means the Terms and Conditions of Use policy of Infinitely People Products;

• "Privacy Policy" means our privacy policy which can be found at Privacy Policy;
• "Cookies Policy" means our cookies policy which can be found at Cookies Policy;
• "Materials" or "Content" means information, data, profiles, cv’s, selection and assessment solutions, performance management solutions, surveys and questionnaires or any human capital products provided by us;

General Information

• These Terms and Conditions of Use, together with the documents referred to herein, explain the terms and conditions of use which apply to your use of Infinitely People Products, their entire content and any of its related Products.
• Please ensure you read these Terms of Use carefully before you use the Products.
• By choosing to access and use the Products you are accepting and agreeing to be bound by the Terms and Conditions of Use policy outlined below and those contained in our Terms of Business and Privacy Policy, whether you are using it as a visitor or registered user. If you do not agree with the policies or do not wish to be bound by them you should not use or register to use any of the Infinitely People Products.
• If you choose to purchase any of our Products, then that purchase will be governed by our Terms of Business.
• Our Products use cookies and by using them you are consenting to our use of cookies in accordance with the terms in our Privacy Policy and Cookies Policy.
• We reserve the right to change these Terms and Conditions of Use at any time, without providing you with any notice. It is your responsibility to check them regularly or each time before you agree to purchase any services or products via our Products (e.g. websites or apps) and ensure you understand the terms that apply at that time. We agree that changes cannot be retroactive. If you object to any changes, you may close your account at any time.

Disclaimer

Products and Service Access

• While we attempt to ensure our Products are available 24 hours a day, we will have no liability for the inability of anyone to access our Products or any information, material or service on them at any time or for any period.
• We do not warrant that our Products will operate without any interruptions and access to the Products may be suspended temporarily and without notice in case of system failure, maintenance, repair or reasons beyond our control.
• We will have no liability to you or others regarding the Products including failure to login, access the Products or stay online.
• From time to time we may restrict access to some parts of the Products, or our entire Products for both visitors and those who have registered with us.
• We reserve the right to suspend/disable your access to our Products or your registration as a user immediately if you fail to comply, or we have reasonable grounds to believe you are failing to comply, with any of these Terms and Conditions of Use or any document referred to herein.
• We do not commit to store or keep showing any information and Content that you have submitted or posted. We are not a storage service. You agree that we have no obligation to store, maintain or provide you a copy of any content that you or others provide, except to the extent required by applicable law and as noted in our Privacy Policy.
• If the need arises we may elect at any time, without any notice or explanation, to suspend or discontinue access to our Products or part thereof or close them indefinitely. You will not be entitled to any form of compensation upon the discontinuance or alteration of any Products.
• We may modify our prices effective prospectively upon reasonable notice to the extent allowed under the law.
• Although Infinitely People reserves the right to review and remove Content that violates its Terms and Conditions of use, such Content is the sole responsibility of the user who posts it, and we cannot guarantee that all Content will comply with our Terms and Conditions of Use. If you see Content on any of our Products which violates the Terms and Conditions of Use, please report it within the contact section of our Products or via our support@infinitelypeople.com email.

Accuracy of Information

• While we attempt to ensure all information on our Products is accurate and correct, we make no representation and give no conditions, guarantees and warranties that any information or material on or contained in our Products is accurate, up to date or complete. The Content, material and information provided on our Products is therefore provided “as is” without any conditions, warranties or any other terms of any kind.
• We accept no liability for any loss or damage incurred by inaccurate information or by the manner in which that information was used or interpreted by others.
• We also make no commitment and are under no obligation to update the information or material found on our Products.
• We may change the Content of our Products at any time and without any notice.

• If you elect to enter into a contract, purchase products or services or make use of a third-party website or app in any way even if directed from our Products to them, this is a matter between you and them. We shall have no liability for the quality of the products or services provided by a third party who we may mention on our site or app or to whom our site or app is linked.
• We also do not guarantee that our Products or websites or apps which are linked with our Products are free from computer viruses or any other malicious or impairing computer programmes.
• Any concerns you may have concerning any external third-party link should be directed to that site’s website or apps administrator.

User Account and Material/Content Do’s and Don’ts

By creating an account in/on any Infinitely People Product, you grant to Infinitely People a worldwide, transferable, sub-licensable, royalty-free, right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, modify and distribute information you authorise us to access, as well as any information you post, upload, display or otherwise make available on the Products or transmit to other users.

Infinitely People grants you a personal, worldwide, royalty-free, non-assignable, nonexclusive, revocable, and non-sublicensable license to access and use our Products. This license is for the sole purpose of letting you use and enjoy the Products benefits as intended by Infinitely People and permitted by these Terms of Use. Below highlights the do’s and don’ts in relation to your account conduct and how you access, contribute, retrieve, store and utilise the Material/Content when using the Products provided by Infinitely People Products.

Your Account Do’s and Don’ts

• You are responsible for complying with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws, and regulatory requirements when using our Products
• You are only permitted to use our Products if you are a minimum age of 18. However, if the law where you reside or work requires that you must be older in order for Infinitely People to lawfully provide our Products to you without parental consent (including using of your personal data) then the minimum age required by the law is the age you should be.
• You are permitted one account on our Products and are responsible for providing us with accurate information and keeping your profile up to date and secure
• You will at all times use your real name on your profile and conduct yourself in a professional manner. It is not acceptable to provide misleading or deceptive information about yourself, your qualifications, work experience, affiliations, or achievements
• You will not create a false identity, impersonate any person, misrepresent your identity or affiliation with any person, create a profile for anyone other than yourself (a real person), or use, attempt to use or share another’s account on our Products.
• You are responsible for ensuring that all people who access our Products through your internet connection are aware of and comply with these Terms and Conditions of Use.
• Some services available through our Products may be accessible to only users who are preregistered to use the applicable service. Each registration is for a single user only. These registered users may be provided with a user identification code/name, password or any other piece of information as part of our security procedures.
• These users are responsible for ensuring the security of their registration details provided to them. They should be treated as confidential at all times and should not be shared with any other third party or between multiple users on a network.
• While responsibility for the security of any passwords issued rests with the individual users, should you suspect or become aware that your user details are lost or have been stolen, you should contact us as soon as possible to ensure replacement registration/login details are created and provided to you. Users of the system will be responsible for any losses they incur as a result of their failure to keep their username and password secure and confidential.
• We reserve the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with the provisions of these Terms and Conditions of Use.
• If you registered as a business user of our Products, you represent and warrant that you (the individual registering the business) have the authority to do so and to bind any relevant legal entity on whose behalf you are acting.
• You agree to act respectful and courteous when communicating with our customer support team. If we feel that your behaviour towards them is, at any time, offensive or threatening we reserve the right to immediately terminate your account
• We ask every guest and registered user to act responsibly. If you see something that you believe may violate our Terms of Use or any of our other policies, please report it to us immediately. This helps us identify and prevent abuse and misbehaviour on our Products.
• You can cancel your registration as a user of our Products at any time by completing the relevant cancellation process online or by contacting support@infinitelypeople.com. Cancelling your registration will not, however, affect your obligations in relation to any services or information you have previously received.
• Unless you have our permission you will not attempt to create another account if we have already terminated your account
• Any software, upgrades, updates or other new features we provide may automatically be installed

Material/Content Do’s and Don’ts

These Content do’s and don’ts apply to any and all Material which you contribute to our Products, and to any interactive services associated with it. The Content do’s and don’ts must be complied with in spirit as well as to the letter. The do’s and don’ts apply to each part of any Material; as well as to its whole. We will determine, in our discretion, whether content breaches our Content Do’s and don’ts

• Your Content contribution should be accurate (where it states fact) and genuinely held (where it states opinions)
• You should not use our Products in any way or post Content which is illegal, unlawful, fraudulent, harmful, libellous or threatening or which breaches any applicable local, national or international law or regulation
• You are not permitted to post any content which promotes hatred or physical harm of any kind against any individual or group. You are further not permitted to post any content that is hate speech, threatening, incites violence, is sexually explicit or pornographic in nature
• You may not use our Products for the purpose of harming or attempting to harm minors
• You are not permitted to post anything which promotes discrimination based on race, sex, religious or philosophical belief, nationality, disability, sexual orientation or age.
• You are not permitted to intimidate, bully, harass, stalk, annoy, upset, alarm mistreat or defame any person and/or send other unwelcome communications to people (e.g., romantic advances, junk mail, spam, chain letters, phishing schemes)
• You may not abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
• You may not solicit passwords for any purpose or personal identifying information for unlawful purposes from other users or disseminate another person’s information without their permission. Under no circumstances may you disclose any information you do not have the consent to disclose (for example the confidential information of others or your employer)
• You are not permitted to use our Products in any way which is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect , or attempt to deceive, solicit money from any other users
• You may not breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
• You may not advocate, promote, incite any party to commit, or assist any unlawful or criminal act (such as by way of example only, copyright infringement or computer misuse).
• You may not produce Content which contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.
• Any material you choose to transmit or post to our Products or supply to us in relation to our Products will be considered non-confidential and non-proprietary. We will have no obligations in relation to such material. You retain all of your ownership rights in your content, but you provide to us (and our designees) a perpetual, worldwide, non-exclusive, royalty-free, transferable license to use, copy, disclose, distribute, prepare derivative works of, display, and otherwise use such material and all data, images, sounds, text and other things embodied in any such material for any and all commercial or non-commercial purposes, and you confirm that you have all necessary rights and licenses to enable us to do so. Infinitely People’s license shall be exclusive with respect to derivative works created through the use of the Product
• You agree that any Content you place or that you authorise us to place on our Products may be viewed by other members and may be viewed by any person visiting or participating on the Products (such as individuals who may receive shared Content from other Infinitely People members).
• You agree to not violate or infringe on the intellectual property rights of others or that of the Infinitely People Products, including database rights, copyrights, patents, trademarks, trade secrets, other proprietary rights or contract rights.
• You are not permitted to copy, use, disclose or distribute any Content and/or information from our Products whether directly or through third parties (eg: search engines) without our prior written consent
• You may not link our Products to any other websites or apps without our prior written permission. If you would like to create a link to our Products, please contact us first at support@infinitelypeople.com to request such permission. All permission will be provided in writing. We expressly reserve the right to revoke any right which we grant to link to our Products at any time including for breach of any of these Terms and Conditions of Use and to take any action we deem appropriate.
• You understand and agree that we may monitor or review any Content you post on or as part of our Products. We may delete any Content, in whole or in part, that in our sole judgment violates our Terms and Conditions of Use or may harm the reputation of Infinitely People Limited.
• You are not permitted to express or imply that you or any statements you make are affiliated with or endorsed by Infinitely People without our expressed prior written consent
• We reserve the right to disclose your identity to any third party who claims that any posted or uploaded content provided by yourself to our Products constitutes a violation of their intellectual property rights, or of their right to privacy.
• We may take legal action if we discover any unauthorised use or misappropriation, misuse or infringement of our Content, Product functionality, look and feel of our Products or interference with the identity of our Products or taking any action to impair the good-will of our trade names, trademarks or other intellectual property. We will also report any such breach to the relevant law enforcement authorities and co-operate with those authorities by disclosing the identity and location of anyone posting any material in breach of these Terms and Conditions of Use. In the event of such a breach, your right to use our Products will cease immediately.

Infinitely People’s Products Do’s and Don’ts

The following listed behaviours further constitute unacceptable conduct and will result in a criminal offence being committed and legal action being pursued by Infinitely People.

• Attempting to interfere or gain unauthorised access, or use of our Products or otherwise exploit, extract, screen scrape, data mine, data harvest, publish, distribute, or reproduce any part of our Products through developing, supporting or using software, devices, scripts or any other means or processes (including: crawlers, scrapers, site search/retrieval application, browser plugins and add-ons proxy or other manual or automatic device, method or process including any other technology) which enable this
• Reverse engineering, decompiling, disassembling, deciphering or otherwise attempting to derive the source code for our Products or any related technology that is not open source
• Attempting to gain access or interact with our Products using robot (bots), spiders or other electronic automatons to access our Products, add or download profiles, send or redirect messages
• Engaging in framing or mirroring or otherwise simulating the appearance or function of our Products
• Attempting to gain unauthorized access to the server on which our Products are stored or any server, computer or database connected to our Products.
• Attempting to attack our Products or interfere with their operation via a denial-of-service attack, a distributed denial-of service attack, spam or gaming algorithms.
• Knowingly introducing, transmitting, sending, uploading or posting any material or software which contains viruses, malicious code, spyware, Trojan horses, key stroke loggers, worms, logic or time bombs, adware, rootkit or any other material which is technologically harmful or could otherwise compromise the security of our Products or affect the operation of any software or hardware.
• Using meta tags, code or other devices containing any reference to Infinitely People or our Products (or any trademark, trade name, service mark, logo or slogan of Infinitely People) to direct any person to any other website for any purpose.
• Using data collected from our Products for transmitting, procuring or the sending of any unsolicited advertising, promotional material, direct marketing, phishing activity or any other form of similar solicitation (spam) of whatever nature.
• Probing, scanning, testing or monitoring our Products availability, performance, vulnerability or functionality on any system or network for any competitive purposes
• Using or developing any third party applications which interacts with our Products or other users’ content or information without our prior written consent
• Taking any action or using our Products in any way which may interfere, disrupt, corrupt, damage or impair the availability, accessibility and performance of our Products or the servers or networks connected to our Products.
• Using our Products or any Content contained in the Products for any commercial purposes without Infinitely Peoples prior written consent
• Supporting or encouraging any activity which violates our Terms of Use

Breech of This Policy

When we consider that a breach of these Terms and Conditions of Use policy has occurred, we may take such action as we deem appropriate. Failure to comply with these Terms of Use policy constitutes a material breach of the terms on which you are permitted to use our Products and may result in our taking all or any of the following actions:

• Immediate, temporary or permanent withdrawal of your right to use our Products.
• Immediate, temporary or permanent removal of any Contribution uploaded by you to our Products.
• Issue of a warning to you.
• Disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.
• Seek compensation for any loss, damage, cost or expense we suffer as a consequence of a failure by you to observe and comply with the conditions of these Terms and Conditions of Use policy or any document referred to herein.

We exclude our liability for all action we may take in response to breaches of these Terms of Use policy. The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.

Privacy and Data Protection

• Please read our Privacy Policy to help you understand how we use your personal data and protect your privacy.
• Whenever you provide us with personal information you are consenting to us using it in accordance with our Privacy Policy and warrant that all data provided by you is accurate.
• You agree that Infinitely People Limited may use and/or disclose information about you your demographics and use of the Products in any manner which does not reveal your identity unless it is required as part of the service offered by the Products in order for you to effectively use the Products.
• By participating in site promotions, contests and polls and contacting Infinitely People via the Products you agree to us using your information for marketing and promotional materials.
• We reserve the right to change our Privacy Policy at any time, without providing you with any notice. It is your responsibility to check them regularly.

Intellectual Property

• Except where otherwise indicated the Content and Material (including without limitation photographs, logos, trademarks and graphical images) on our Products are protected by copyright, database rights and other intellectual property rights that belong to us, our affiliates, holding or subsidiary companies, or licensors, unless otherwise stated or indicated.
• All rights which are not expressly granted in these Terms of Use are reserved. All our rights in the content and design of our Products are reserved. No part of our Products may be reproduced or stored in any other website or apps or included in any public or private electronic retrieval system or service.
• Notwithstanding the above you may read, print and download material from our Products in a web browser or app (other than third party material), subject to the other provisions of the disclaimer free of charge provided it is:
  • for personal use in the ordinary course of business;
  • reproduced accurately;
  • not used in a misleading context; and
  • the source of the material is identified and the copyright status acknowledged.
• Unless you own or control the relevant rights to the materials you may not republish, redistribute, sell, rent or sub-license Material from our Products.
• You may not use, republish, disseminate or transmit any part of the materials on our Products in public or for commercial purposes or for any other purpose not permitted by these Terms and Conditions of Use without obtaining prior written permission to do so.
• Use of any extracts from our Products is prohibited. In particular, you are not permitted to publish, distribute or otherwise reproduce in any format any of the content or copies of the content of our Products.
• You may not copy, modify, translate, reverse engineer, decompile, disassemble, or create derivative works based on any software or any documentation accompanying such software or other content available on or through our Products.
• No license is granted to you in the Terms and Conditions of Use to use any of our trademarks, trade names, service marks copyrighted material or images or other intellectual property information accessible through our Products.
• If you breach any of these Terms and Conditions of Use, your permission to use our Products automatically ceases and you must immediately destroy any downloaded or printed extracts from our Products.

Purchases

If you chose to purchase any of the Infinitely People Products’ services or goods, you consent to be bound by our Terms of Business. We encourage you to read our Terms of Business policy prior to purchasing any of our services or goods to full understand your rights and obligations.

Limitations and Exclusions of Liability

Infinitely People Limited will not be liable to you or any other party for any loss whatsoever; be it direct or indirect, as a consequence of using our Products.

• Nothing in Terms and Conditions of Use shall limit our liability for:
  • death or personal injury caused by negligence (as such term is defined by the UK Unfair Contract Terms Act 1977);
  • fraud or fraudulent misrepresentation; and/or
  • any liability which is not permitted or excluded under applicable law.
• The limitations and exclusions set out herein govern all liabilities arising under the Terms and Conditions of Use or subject matter thereof, including liabilities arising in contract, tort (including, without limitation, negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with our Products
• We will not be liable to you or any other party for any loss whatsoever; be it direct or indirect, as a consequence of using our Products or processes.
• We and any other party (whether or not involved in creating, producing, maintaining or delivering our Products), and any of our officers, directors, employees, shareholders or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage. Damages include without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, revenue, anticipated savings, profits, commercial opportunities or goodwill, contracts, use of money, or loss or damages arising from or connected in any way to business interruption.
• We will not be liable for any loss or damage due to virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, data, database, software or other property on account of your access to, use of, or browsing our Products or your downloading of any Material from our Products or any websites or apps linked to our Products. If your use of Material on our Products results in the need for servicing, repair or correction of any of your equipment, software or data, you shall be responsible for any related costs.
• If you have purchased Products or services from us our liability is governed by our Terms of Business.

Law and Jurisdiction

• These Terms and Conditions of Use policy shall be governed by English Law and you agree that any disputes relating to these Terms and Conditions of Use policy shall be subject to the exclusive jurisdiction of the courts of England and Wales, except if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
• If any provision in these Terms and Conditions of Use Policy is for any reason, held by any court or other competent authority to be invalid, unenforceable, illegal in any way either in whole or part, the validity of the remainder of the provision and the other provisions of the Terms and Conditions of Use policy shall not be affected and will remain in full effect.
• No delay or neglect by us to enforce these Terms of and Conditions of Use will be deemed to or will be a waiver or in any way prejudice any of our rights.

Further Legal Information

• In using any of our Products or Materials all individual users (purchasers and registered users) shall be required to verify any local requirements and/or restrictions on using these types of Products or Materials in that jurisdiction, whether imposed by law, regulation or by a local regulatory or governmental body.
• It is the sole responsibility of the individual user to ensure that the use of the Products or Materials fully complies with any and all such local requirements and/or restrictions where any local requirements and/or restrictions exist that alter the criteria for, or prevent, use of the Products or Materials within a particular jurisdiction.
• Where any individual or entity uses Products or Materials in a particular jurisdiction in contravention of any local requirements and/or restrictions, whether knowingly or inadvertently, such individual or entity shall be solely responsible and liable for such use and shall hold us harmless and indemnify us in respect of any loss or claim arsing by a third party.
• An individual user wishing to return Materials due to not ensuring such Materials may be legitimately used within a particular jurisdiction shall be liable for the costs for the return of Materials and/or the reimbursement of any associated costs.
